Background
The key long-term challenge in Bosnia and Herzegovina’s water sector is the lack of financial sustainability of water utility companies. Capacities to appropriately manage finances are limited. Accounting and budgeting practices often do not comply with national legislation requirements or international professional standards. Financial analysis capabilities and the associated ability to undertake strategic financial planning are also inadequate. As a result, water utilities are incapable of investing in their equipment, infrastructure maintenance, or development. Furthermore, they are not capable to calculate full cost recovery tariff for water and wastewater services and they cannot justify their needs which are neglected from decision makers. They also lack performance-based management systems and rarely assess public satisfaction with their services. If these institutional weaknesses are not addressed, not only will the current problems with water delivery and quality control persist, but efforts to improve them will not be sustained in the long run. The overall objective of this project is to prepare basic analysis of the possible scenarios of establishing a regulatory framework in the water and sanitation sector, to safeguard and protect the public interests on the one hand, and to establish a transparent legal and regulatory environment in order to protect consumer interests.
Objective
The main objective is preparation of the scenario for the establishment of water and sanitation water tariff regulatory framework. The proposal will provide UNDP with the guidance for next steps regarding institutional and legislative setup of regulatory framework (including detailed step by step process with roles and responsibilities, rules and procedures, sub laws, etc.).
Responsibilities
- Analyze current situation in the water supply and sanitation sector legislative framework
- Detailed overview of legislative set up in the water supply and sanitation sector
- Mapping main legislative documents (laws, sub/laws, rules and procedures, etc.) in the sector
- Presentation of the current framework to the UNDP designated National Water Expert
- Provide support in defining different scenarios for establishment regulatory framework
- Based on the input from National Water Expert, for different solutions of regulatory framework provide overview of the needs for adapting existing and/or creation new legislative framework
- Upon definition of the final Scenario of institutional and legislative setup of water tariff regulatory framework, prepare detailed list of necessary legislative changes
Requirements
- University degree in Law with relevant experience in water management and environmental protection
- 10 years working experience in water management and environmental protection sector
- Excellent knowledge on the current state of the legislative framework in water management and environment protection sector in Bosnia and Herzegovina
- Experience in working with water management and environment protection sector in B&H and region
- Experience on establishing legislative and administrative framework
- Experience on providing capacity development assistance to public sector
- Ability to work independently
- Excellent inter-personal and communicational and presentation skills
- Knowledge of the political and economic situation in the BiH.
- Fluency in both written and spoken B/H/S languages is a must
- Fluency in both written and spoken English language is a must
