Background
The European Bank for Reconstruction and Development ("EBRD", or the "Bank") has been requested to assist the Serbian Ministry of Justice (the "Ministry") with the revision of the legal framework for taking and enforcing mortgages, with the view of tackling the problems which have arisen in the implementation of the current Mortgage Law (the "Assignment").
The Assignment would consist of:
- providing support to the Ministry in reviewing the current regime and specifically confirming and further identifying its deficiencies
- assisting with the necessary amendments and consulting the relevant stakeholders
- providing support to the Ministry in the legislative adoption phase.
Responsibilities
- Organise regular stakeholder meetings with banking association, relevant business associations, cadastre and land registries and other
relevant stakeholders in order to ascertain the extent of the needed changes from the perspective of the end users of the law
- Assist the Ministry in preparing all supportive documents needed for the successful finalisation of the legislative process (justification for
the change of legislation, draft the Regulatory Impact Assessment, etc.)
- Assist the Ministry in producing a draft law in Serbian that can enter into procedure of adoption
- Advise on the local legal framework and court practices in order to help the Working Group to decide on the most appropriate legal
solutions that would need to be adopted
- Contribute to the Working Group's work by presenting the proposed amendments, discussing solutions, answering all queries that may be
raised and providing additional information which may be required;
Eligibility
There are no eligibility restrictions for the nationality of the Consultant nor for the experts proposed.
The Consultant will be a law firm with:
- High-level legal and regulatory expertise
- Capacity to provide technical support based on high-level experience in policy work and legislative process
