EBRD/ MONTENEGRO: COMMERCIAL LAW JUDICIAL TRAINING SUPPORT

Background

The European Bank for Reconstruction and Development (the EBRD or the Bank) intends to implement a judicial training project to strengthen the ability of Montenegrin judges to deal effectively with certain types of commercial law matters. The EBRD has been conducting policy dialogue with the Judicial Training Centre (JTC) of Montenegro concerning the training needs of judges in commercial law. The most recent needs assessment conducted indicates that there is a strong need and demand for training on company law, insolvency, maritime law and consumer protection. These are topical and specialised areas on which most Montenegrin judges have received little or no recent training. The number of insolvency matters and claims involving company law has risen significantly in recent years. Maritime disputes involve complex questions of jurisdiction and substance, such as in relation to maritime liens and security, and the seizure of vessel. Consumer protection legislation is expected to become better known in the lead up to accession, generating claims from consumers. The JTC has requested the Bank's assistance to deliver modules of judicial training in these areas, with a particular focus on the practice of courts in the European Union. The EBRD now wishes to retain a consultant to prepare modules of training in these four areas, and to deliver the four modules of training to one class of up to 30 judges


Objectives

The main objectives of the Assignment are to provide practical professional training that enhances the knowledge of Montenegrin judges in the areas concerned and improves their ability to deal effectively with such matters.


Budget

Cost Estimate for the Assignment: EUR 95,663; exclusive of VAT.
