Alternative Dispute Resolution (ADR) should be seen as an integral part of any modern civil justice system. Citizens should be given a variety of options to resolve their disputes in a way which best meets their interests and goals. ADR methods aim at improving access to justice,reduce court backlogs, reduce formality and complexity of the existing processes, increase satisfaction with dispute resolution, etc.
The approval of the new law "On Mediation in Dispute Resolution" in February 2011 has created broader possibilities for providing the mediation service, as an out-of-court alternative dispute resolution approach. According to the mediation law, the mediation service may be offered to civil disputes, family and criminal ones. Mediation is given priority in those cases where the interests of the minors are in question, especially in family matters.
The legal basis for mediation and restorative justice application in Albania is based on international instruments, such as the Recommendation Rec. (99) 19 of the Council of Europe, “Principles of the United Nations on the Use of Restorative Justice Programs in Criminal Matters” (2002), UN Convention on Human Rights, etc.
- The overall Project Objective is: to increase the efficiency and self-sustainability of Alternative Dispute Resolution services in Albania.
- Project should support: The further development and consolidation of mediation and arbitration services in Albania.
The proposal made by the MS should include the activities they propose to achieve the results listed in the fiche.
Eligibility
Only Public Administrations and Mandated bodies as per Twinning Manual of European Union MS may apply through European Union MSs’ National Contact Points.
Budget
Maximum amount made available under this Call for Proposals is: EUR 735,000. IPA contribution is 95% or 700.000 (EUR) while 5% or 35.000 (EUR) are co-financing.
